Importance of Fundamental Rights under Indian Constitution

Abstract: This research paper describes about the fundamental rights guaranteed to the citizens within the Indian Constitution. Fundamental rights are the most basic rights which are required to uphold human dignity. This right affirm the principle of natural law that no one is above law by granting a set of right to the citizens that cannot be taken away by the government. The Fundamental rights have been covered under Chapter III of the constitution and contain broadly, rights such as Right to equality (Articles 14-18), right to liberty (Articles 19-22), right against exploitation (Articles 23-24), right to freedom of religion (Articles 25-28), right to culture and education (Articles 29-30) and right to constitutional remedies (Articles 32-35). The Fundamental rights have been the cornerstone of the constitution and have been subjected to a lot of adjudication. For protection of such freedoms, people may reach the Supreme Court by writing the writs such as the habeas corpus, quo warranto, mandamus, prohibition and certiorari.

Abstract: The present feminine novelists have advanced their style which expresses women’s awareness. Each novelist is different from the other. Every novelist has her own expectations of experiences, her perspective of analyzing the things, and her narration of the persona is different. But there is one point similar in them. They focus on a deep sense of enlightening social change. The works of the Indian women novelist like Kamala Das, Shobhaa De, Anita Nair, Toru Dutt, Sarojini Sahoo, Nabaneeta Dev Sen, etc. can be compared with the present Canadian novelists, like Marie-Claire Blais, Bonnie Burnard, Heather O’Neill and. Lisa Moore. All these authors write of women’s life and life of affecting women.

Abstract: Jhabvala gives a revelation and an enjoyable change for her readers in her novel A New Dominion. It makes a different point in Jhabvala’s literary profession, and a divergence from the rule which stroke her previous works. The novel deals about India but with a new viewpoint. It is additional concerning the new phenomena of argument between the Indian spiritualism and the Western seekers. It is a horrible proposal and despair tale about European women weary of covetousness; European trips to India on a spiritual search and end up in fantasy. Europeans are naive, innocent and feeble nerve, the Indians no better; and also perpetually petite minded and sensual with a total 42 deficiency of any true love or attraction. The theme East-West encounter does not present in this novel but rather East-West agreement or eventual compromise.

Abstract: Volleyball has changed a great deal since William Morgan first invented the game in a YMCA gymnasium more than 100 years ago. However, as you can see from the first line of his rulebook, the spirit of the game has remained the same. Morgan’s visionary flexibility in the number of participants and acceptable venues for the sport has resulted in incredible participatory popularity. From backyard grass courts to sand volleyball Olympic venues and major arenas, volleyball is one of the most popular sports in the world. In the United States alone, 6.6 million men and women play volleyball annually.

Critical Analysis of Right to a fair trial under Indian law

Abstract: “Lex uno ore omnesalloquitur” which means that everyone is equal before the eyes of the law which is an important principle which forms the basis of judicial proceedings across the world. The law treats everyone equally and this principle is enshrined in various provisions of the Indian Constitution. Article 14 of the Indian Constitution exclusively deals with the Right to Equality. Trials are an indispensable part of any proceeding. Conducting fair trails is an important aspect of the law which ensures equality. The concept of a fair trial is not just a right provided in our country but it is also guaranteed by various other legislations all over the world. Article 6 of the European Convention on Human Rights deals with the Right to a fair trial. According to this Article, everyone is entitled to a fair and public hearing within a reasonable time. The trial must be conducted by an independent and impartial tribunal established by law.

Offense and outraging the modesty of women in India

Abstract: Section 354 of the IPC, 1860 deals with associate degree assault or criminal force to lady with associate degree intent to outrage her modesty. Until 2007, there was an excellent deal of ambiguity on what implanted a lady's modesty and diverse speculations regarding the definition of modesty of a girl were gift. Several cases were determined whereas not an exact definition of a woman's modesty. However, the Supreme Court in inside the case of Ramkripal v. State of Madhya Pradesh, printed modesty by giving birth down that the essence of a woman's modesty is her sex'. Therefore, associate degree crime against women that falls wanting penetration would represent an offence beneath section 354 of the IPC, increasing the reach of crimes falling beneath this section. It had been extra command inside the judgement that the word modesty' is not to be understood with relation to a particular victim of associate degree act, but as associate degree attribute associated with female person who reflects a particular class. Therefore, modesty is regarding a female individual of any age with differing degrees of what would represent modesty at a given age of a female. These cluster of words can usually be substituted with molestation which suggests to force physical and usually sexual contact on someone and to make unwanted or improper sexual advances towards someone and a female of any age is misunderstood.

Abstract: In India, there are secular provision as well as personal law provisions to regulate the maintenance of the child. Judicial precedents show that in matters of conflict the prime focus of the judiciary is in favour of welfare of the child. There are many loopholes in the personal laws of the people. Uniform civil code may be seen as a remedy to solve the conflicts that arise due to the different personal laws.

Abstract: Warrant cases means the cases which are a more serious offence that is punishable with death, life imprisonment or imprisonment for a term exceeding two years. The trials of warrant cases are conducted by the Court of Session or by Magistrate. If the offence is more serious then it is triable by the Court of Sessions, whereas if the offence is less serious warrant case then it is triable by the Magistrate.

Abstract: Water generally collects in a river from precipitation and other sources such as groundwater recharges, springs, natural ice snow packs and climate changes, heavy rains, droughts affect the river. It is possible to predict what climate conditions will be like in river basin catchment areas in the next 50 years roughly through Monsoon Time Scales. According to an estimate, the Chenab river will overflow with floods in the coming years. Through this research proposal we can know the future consequences of the Chenab river. Plans can be made accordingly. So, scientists can establish Monsoon Time Scale for that river basin catchment areas and predict what is going to happen in the Chenab river basin catchment areas in the coming 50 years roughly.
